Can I Dismiss my Agent to Sell My Home?

A friend told me I can dismiss my agent to sell my home. I’ve never heard that before, so it didn’t seem possible because I signed a contract and agreed to let the real estate company list and show my house for a period of six months. That time period is not up yet.

So, I did some research online to find out if my friend was correct, and what he told me is true. My agreement to allow the listing agent to represent my home for sale and collect a real estate commission when a sale closes can be terminated unless there is a buyer who is ready, willing and able to purchase my home and a sale is in process.

Under those circumstances the listing agent has tentatively earned his or her commission and it would not be fair or legal to cancel my listing agreement. The real estate broker could take me to court and a judge would order me to pay the commission based on our signed contract.

I don’t want to go to court with my agent, I just want to cancel my listing agreement because I need to sell my house right away, on my own, without an agent. I don’t owe the real estate company any money because the contract says they are responsible for any costs they incurred in the process of finding a buyer, whether they found a buyer or not.

Finding a Buyer to Sell My Home

I tried listing my home and selling through an agent, but a couple months have passed, and it still has not sold. So, finding a buyer to sell my home is now my own responsibility.
